Constitution of the
Student Council of
Olathe Northwest High School

PREAMBLE
We, the students of Olathe Northwest High School, in order to establish a representative government; to encourage the development of leaders and participants for the school, the community, and responsibilities of students in relation to the school, the community, and the general welfare of this institution; do hereby ordain and establish this constitution.

ARTICLE I
Name & purpose
Section 1. The name of the organization will be the Student Council of Olathe Northwest High School.
Section 2. The purpose of the Student Council will be:
2.1 To provide the means whereby the members of the student body may express themselves effectively through programs in areas which directly affect the general welfare of the student body in any aspect of the school experience in which they choose to participate.
2.2 To establish equitable representation and participation for the students in the governance of the school community.
2.3 To promote mutually beneficial cooperation among students, faculty, and administration in furthering the purposes for which the school was founded.
2.4 To promote democratic participation in the decisions of the school community.

ARTICLE II
Membership
Section 2. All students of Olathe Northwest shall be the students and a council of their peers shall be the delegation titled Student Council.
2.1 No person shall be, on the grounds of race, creed, color, national origin, religion, age, sex, sexual orientation, handicap, or such other factors that cannot be considered lawfully be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity within this organization.
2.2 All members of the Olathe Northwest Student Council will be required to sign the Olathe District Schools USD #233 Athletic/Activities Substance Abuse Policy.

ARTICLE III
Officers
Section 1. Officers of Student Council.
1.1 The officers of Student Council will consist of the president, vice president, secretary, executive chair,
1.2 The officers will be elected during April and hold office for a term of one (1) year beginning the third Monday in May of the year of their election and terminating the following year on the same day.
1.3 All candidates for an office must:
1.3.1 Be enrolled as a full-time student in good standing at Olathe Northwest.
1.3.2 Have and maintain a cumulative grade point average of 3.0
1.3.3 Be an active member of Student Council as approved by the sponsor.
1.3.4 Adhere to the rules and policies set forth in the Olathe Schools Student Code of Conduct
Section 4. Succession
4.1 To insure continuous and orderly leadership for Student Council, the following order and rule for succession will be followed.
4.1.1 If the president is unable to perform his or her duties for whatever reason, the vice president shall assume the office of the president.
4.1.2 The secretary will then assume the duties of the vice president and face immediate Senate confirmation.
4.1.3 If the secretary is unable to perform the duties of the vice president, nominations will be made from the floor of the Senate and the full Senate will vote on the nominations, nominee must have 40% of the total vote.
4.1.4 If no nominee receives 40% of the first ballot, the nominees who placed first and second in the balloting will be placed on a ballot for a second vote, nominee receiving the most votes will be sworn in as vice president.
4.2If the office of president becomes vacant, the vice president will secede to the office.
4.3 If the office of vice president becomes vacant, the secretary will secede to the office.
4.4 If the office of secretary becomes vacant, the Senate will elect a new secretary from an Executive Board nomination.
Section 5. Removal from Office
5.1 Any officer may be removed from office by impeachment that may be initiated by a two-thirds (2/3) vote as a regular meeting of the Senate.
5.2 A three-fourths (3/4) vote of the Senate at the next regular meeting will result in the removal of the impeached.
5.2.1 Failure to perform based on a contract signed at the time of induction into the Executive Board may result in immediate removal upon faculty sponsor’s decision.
5.4 Just cause for removal will be:
5.4.1 Violation of or disregard for any part of the constitution of Student Council or the Student Code of Conduct.

Duties of the Officers

ARTICLE V
The Executive Board
Section 1. The Executive Board of the Senate will:
1.1 Be composed of the president, vice president, secretary, and appointed committee chairs as determined by the officers and the sponsor.
4.2 The duties of the Executive Board are to coordinate the activities and operations of student government and to assist the president in implementing legislation enacted by the Senate.

ARTICLE VII
Student Senate
Section 1. Composition of the Student Senate
1.1 The student body will be represented by senators from Olathe Northwest.
Section 2. Qualifications and Responsibilities of a Senator
2.1 At the time of election or appointment and throughout the term of office, a senator must be an enrolled student in good standing and not in violation of the Student Code of Conduct.
Section 3. Term of Office
3.1 The term of office of the senators will begin on August 31 of the year of their election and terminate the following May 31.
Section 4. Meetings of Student Senate
4.1 The Student Senate will meet at least once a month unless otherwise noted.
4.2 One meeting will be scheduled during the summer.
4.3 The president of the Senate may call the Senate into emergency meeting upon proper notification of all senators.
4.3.1 All Senators must be notified 24 hours before the meeting.
4.4 The Robert’s Rules of Order for Student Senate will govern the procedures of Senate meetings.
4.5 In order for legislation to be acted upon at Student Council, a quorum (two-thirds (2/3) of the Senate roll) must be present.
4.6 The Senate will have at least one faculty adviser and an assigned administrator.
4.6.1 One of these advisors should be present at all meetings of the Senate.

Section 1. Amendments
1.1 Amendments to this constitution may be proposed by a two-thirds (2/3) majority vote of the attending Student Senate.

Article I
Duties of Members

Section 1. The president of Student Council will:
1.1 Serve as the chief executive of the Student Council.
1.2 Act as the official host and representative of the Olathe Northwest student body.
1.3 Represent the concerns of the students to the Senate, the faculty sponsor and the administration.
1.4 Have the power to sign Senate legislation or delete by veto such legislation or any part thereof provided that he/she acts within ten (10) class days of transmittal of the legislation by the secretary.
1.5 Be responsible for implementing legislation enacted by the Senate.
1.6 Appoint and, if necessary, remove the chairpersons of the Senate, committees from within the Senate membership, with the approval of the Senate.
1.7 Prepare agendas for and preside over meetings of the executive board and Senate and coordinate the performance of duties by the members.
1.8 Have the power to nominate student representatives to all student/faculty boards, councils, and committees with the approval of the Senate and faculty sponsor.
1.9 Prepare, with the cooperation of the finance chairperson and faculty sponsor, the annual budget and a monthly account of all expenditures.
1.10 Have the power to call the Senate into emergency meetings upon proper notification of all senators and the faculty sponsor.

Section 2. The vice-president of Student Council will:
2.1 Serve as a committee chairperson within the Senate. 
2.2 Distribute the agenda for the Senate, given him/her by the president. 
2.3 Assist the president in the performance of his/her duties. 
2.4 Serve as a member of the executive board.
2.5 Call Senate into emergency sessions upon proper notification of all senators and faculty sponsor.
2.6 Organize and oversee all fund-raising projects
2.7 Prepare the Legislative Summary at the end of each year, to be presented at the end-of-year meeting.

Section 3. The Secretary of Student Council will:
2.1 Serve as a committee chairperson within the Senate. 
2.2 Maintain maximum communication between the Student Senate and the Executive Board
2.3 Be responsible to inform any and all members of Student Council of upcoming meetings, both scheduled and emergency
2.4 Work with the sponsor to keep track of all financial matters related to Student Council
2.5 Keep track of all Student Council minutes to be presented to the Student Senate at the end of the year.

Section 4. The Student Senate will:
4.1 Be the legislative body of Student Council.
4.2 Have the power to grant Senate recognition to student activities and organizations.
4.3 The Student Senate will not have the power to intercede in internal affairs of a recognized organization unless:
4.31 The organization or a situation in that organization presents a threat to the well-being of a student or students or Olathe Northwest or school relations with the community.
4.32 The organization requests such intercession.
4.4 Have the power to make rules and regulations necessary for proper administration of elections and installations of elected officials.
4.5 Confirm or reject, by majority vote, the appointments of the president.
4.6 Have the power to propose amendments to this constitution.
4.7 Have the power to create ad hoc committees which will investigate and report in any appropriate area.
4.8 Have the power to establish committees to carry out the legislative and student service programs of the Student Council as approved by the President and Faculty Sponsor.
4.9 The standing committees will be responsible to the Student Senate and will be composed of and chaired by senators appointed by the president.
4.10 Formulate and review budget policy as it applies to all Senate appropriations.
4.11 Appropriate monies from the treasury to organizations and activities according to the current financial situation and needs.
4.12 Provide for the compilation and publication of legislation at the close of the spring semester, in order that the student body be informed of the Senate members present.
4.13 Submit referenda to the Associated Students by a two-thirds (2/3) vote of the Senate members present.
4.14 Have the power to petition the president of Student Council to call a special meeting by a two-thirds (2/3) vote of the Senate members present.

Article II
Legislation

Section 1. Legislative Process
5.1 Legislation shall be proceeded with and transacted in accordance with the procedures set forth by the President and faculty sponsor.
5.2 All members of the Senate will have one vote; the presiding officer of the Senate is required to vote in case of a tie and will vote in only such a case.
